Terms and Conditions - Private Group Training

These terms and conditions apply to all private group training bookings made with Continuum Experience, a project of Kristie Walker Pty Ltd (ABN 76 103 692 235) ("we", "us", "our"). By accepting a quote or paying a deposit, the booking organisation ("you") agrees to these terms.

1. About us and our courses

Continuum Experience is a project of Kristie Walker Pty Ltd (ABN 76 103 692 235). We deliver Standard Mental Health First Aid (MHFA) training, Standard Mental Health First Aid Refresher training, Conversations About Suicide training, as Licensed MHFA Instructors. These courses are authored by Mental Health First Aid Australia (MHFA Australia) and recognised by Suicide Prevention Australia.

Continuum Experience is not Mental Health First Aid Australia. Accreditation is issued by MHFA Australia, subject to their requirements.

2. Quotes

Quotes are valid for 30 days from the date of issue unless otherwise stated in writing.

Quotes are based on the group size and delivery details provided at the time of enquiry. Significant changes to participant numbers, dates or delivery format may affect the quoted price. We will notify you of any price variation in writing before proceeding.

3. Confirming your booking

A private group booking is confirmed when:

(a) you accept the quote in writing (email is sufficient), and (b) a 50% deposit of the quoted total is received.

Until both conditions are met, no date or cohort is reserved.

The deposit invoice will be issued on acceptance of the quote. Payment is due within 7 days of invoice date.

4. Balance payment

The balance of the quoted fee is due 14 days before the date of Workshop 1 for each cohort.

For multi-cohort arrangements, each cohort is invoiced separately and the balance for each is due 14 days before that cohort's Workshop 1 date.

If payment is not received by the due date, we will issue one reminder. If the balance remains unpaid 7 days before Workshop 1, we reserve the right to cancel the cohort. In this case, the deposit will not be refunded.

5. Participant eligibility

All participants must:

  • Be aged 18 years or over

  • Be an Australian resident (for the purposes of MHFA Australia accreditation requirements)

  • Have access to a computer or device with a stable internet connection, webcam and microphone for Zoom workshops

  • Provide a valid personal email address to create their MHFA Australia learner account

You are responsible for confirming participant eligibility before registration.

6. Minimum and maximum numbers

MHFA Australia requires a minimum of 6 and a maximum of 12 participants per online cohort. These limits are set by MHFA Australia and are non-negotiable.

If participant numbers fall below the minimum of 6 prior to Workshop 1, we will notify you and work with you to either:

(a) reschedule the cohort to allow additional participants to register, or (b) proceed at the minimum cohort pricing.

We will not deliver a cohort with fewer than 6 participants without prior written agreement from both parties.

7. Non-completion or non-attendance

Continuum Experience is not responsible for participant non-completion and does not provide refunds for non-attendance or non-completion.

At our discretion, and where scheduling permits, we may offer a participant who missed a workshop the opportunity to attend the equivalent workshop in a future cohort. An additional fee may apply.

8. Course materials

A printed course handbook is provided to each registered participant.

Handbooks are ordered based on confirmed registrations.

Participants are required to have their course handbook available during the Instructor-led components.

9. Cancellation or rescheduling by you (the booking organisation)

Cancellations and reschedule requests must be provided in writing to hellocontinuumexperience@gmail.com.

The following conditions apply to cancellation or rescheduling of a full cohort, not to individual participant changes (see clause 10).

Notice given before Instructor-Led Workshop

  • 7 or more days - cancellation or reschedule: Free reschedule to an agreed future date, or full refund - less the cost of any eLearning vouchers already activated.

  • Less than 7 days - reschedule: $1,000 + GST rescheduling fee applies - less the cost of any eLearning vouchers where allocated and already activated.

  • Less than 7 days - cancellation: No refund

eLearning vouchers are non-refundable once activated by participants, regardless of the notice period given.

10. Individual participant changes and substitutions

You may substitute a registered participant with another eligible participant at any time prior to the Instructor-led workshop (workshop 1), at no additional cost, provided the replacement participant has sufficient time to complete the eLearning (if relevant) before Workshop 1.

If an individual participant withdraws and is not replaced:

  • The fee for that participant is non-refundable if their eLearning voucher has been allocated and activated.

  • If their eLearning voucher has not been activated, a credit may be applied to a future cohort at our discretion.

Note: any special conditions agreed in writing on a specific quote (for example, the ability for individual participants to transfer between cohorts at no charge) take precedence over this clause for that booking.

11. Cancellation by Continuum Experience

In the unlikely event that we need to cancel or reschedule a cohort, we will notify you in writing as soon as possible. You may choose:

(a) a full refund of all amounts paid, or (b) transfer of your booking to an alternative agreed date.

We will not be liable for any costs incurred by you as a result of a cancellation by us beyond the refund of amounts paid.

12. Accreditation

Participants who successfully complete all course requirements - including the eLearning, both workshops and the accreditation assessment - will receive a Certificate of Accreditation as an MHFAider, issued by MHFA Australia. Accreditation is valid for three years.

Accreditation is subject to MHFA Australia's requirements at the time of delivery. Continuum Experience does not control and is not responsible for changes to MHFA Australia's accreditation requirements.

Participants are provided with membership to the MHFA Australia learner platform, where their certificate and course records are stored.

13. Participant wellbeing

MHFA courses include discussion of sensitive topics including suicide, self-harm, depression, anxiety and psychosis. This training is educational and is not a substitute for professional mental health advice, diagnosis or treatment.

We encourage organisations to advise participants of the course content in advance and to consider whether appropriate support is available to participants during and after the training.

14. Intellectual property

All course materials - including handbooks, eLearning content, videos and workshop resources - are the intellectual property of Mental Health First Aid Australia or Continuum Experience respectively. Materials are provided for participant learning only and may not be copied, reproduced, resold or used to deliver training without written permission from the relevant copyright owner.

15. Privacy

Personal information collected from participants (including name, email address, mobile, and postal address) is used solely for the purposes of course registration, delivery of course materials, communication about the training, and compliance with MHFA Australia's requirements.

Participant information is shared with MHFA Australia for the purposes of accreditation. We handle all personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

16. Liability

Nothing in these terms excludes any right you may have under the Australian Consumer Law. To the extent permitted by law, our liability arising from any course or booking is limited to re-supplying the service or refunding the amount paid.

Continuum Experience is not liable for any indirect, consequential or special loss arising from participation in or absence from a course.

17. Governing law

These terms are governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria. The contracting entity is Kristie Walker Pty Ltd (ABN 76 103 692 235).

18. Updates to these terms

We may update these Terms and Conditions at any time without notice. The version published at continuumexperience.com.au/tcs-private-group-training at the time a quote is accepted or a deposit is paid is the version that applies to that booking. Updates do not affect bookings already confirmed.

19. Variations

These terms may be varied for a specific booking only by written agreement between both parties. Any special conditions agreed in writing on a quote will take precedence over these standard terms for that booking.
